EarthEra Holiday Twitter Contest
EarthEra is giving away several Green Life Kits to followers of @EarthEra via a Twitter contest. Official rules are below, but here are the basics:
- To be eligible to win, contestants must follow @EarthEra on Twitter
- To enter, contestants must retweet the designated message in the designated timeframe and include the #12DaysOfGreen hashtag
- Winners will be selected at random from all eligible entries
- Anyone found using multiple Twitter accounts to enter will be ineligible
- Anyone posting multiple entries (retweets) in a single day will only receive one entry
Official Rules for the EarthEra December 2010 "Twelve Days of Green" Twitter Contest
THE FOLLOWING PROMOTION IS INTENDED FOR THE UNITED STATES ONLY AND SHALL BE GOVERNED BY UNITED STATES LAW AND IS ONLY OPEN TO UNITED STATES RESIDENTS.
- To enter the EarthEra “Twelve Days of Green” December 2010 Twitter Contest you must be a legal resident of the fifty (50) United States (including District of Columbia) and 18 years or older at the time of entry. Employees, officers, and directors of NextEra Energy, Inc. or its subsidiaries or affiliated companies, and any individuals providing services to NextEra Energy, Inc. or its subsidiaries or affiliated companies, through an outsourcer or temporary employment agency or supplier, as well as the immediate family (spouse, parents, siblings, and children) and household members of such employee are not eligible. Void where prohibited or restricted. Participation constitutes entrant's full and unconditional agreement to these Official Rules and Sponsor's decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.

- Timing: The Contest begins on Wednesday, December 1st at 8 a.m. U.S. Eastern Time and ends on Thursday, December 16th at 9 p.m. U.S. Eastern Time (the "Promotion Period").

- From your Twitter account, retweet the designated message. Your response must be posted the same day as the originally posted message
All correct tweets posted within the timeframe will be entered for a chance to win. NextEra Energy Resources reserves the right to determine, in its sole discretion, if an entry is eligible for the contest. Limit of one entry per Twitter account per day. Individuals may win a maximum of one (1) prize.
- Potential winners will be determined by a random drawing conducted by a NextEra Energy Resources representative within three (3) days of the retweet. Potential winners will be contacted via Twitter and required to provide an e-mail address and phone number. The potential winner will be notified by e-mail or by phone within three (3) days of the retweet. Once eligibility has been verified and NextEra Energy Resources receives the winner’s mailing address, NextEra Energy Resources will ship the prize, at no charge, to the winner to a United States address. Neither NextEra Energy, Inc., nor its subsidiaries or affiliated companies shall be liable for unsuccessful efforts to notify a potential winner. Odds of winning depend upon the number of eligible entries received.
- Potential winners will be awarded one of seventy-eight Green Life kits, estimated retail value of $60. All estimated retail values are subject to change based on, among other things, normal price fluctuations associated with the consumer marketplace. No substitution or transfer of prizes or cash equivalent is permitted. NextEra Energy Resources reserves the right to substitute a prize of equal or greater value. Winner is responsible for any applicable federal state or local taxes on any prize received.
- Except where prohibited, acceptance of a prize shall constitute and signify a winner's consent to the use of his/her Twitter account name, actual name, or both for advertising and promotional purposes without further compensation. By registering to enter the Contest, entrants affirm that they have read and accepted these Official Rules.
- Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, at any time, if any fraud, technical failure or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor, or for any other reason, in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it suspects of tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other Promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal law, and should an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
- NextEra Energy Resources is not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware failure or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Contest, provided that the entry Period has not ended. If the Contest is canceled, suspended or modified, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by random drawing among all legitimate, un-awarded, eligible prizes claims.
- Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by United States District Court for the Southern District of Florida. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules (whether of the State of Florida or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Florida. ENTRANT HEREBY KNOWINGLY, VOLUNTARILY AND INTENTIONALLY WAIVES ANY RIGHT TO A TRIAL BY JURY WITH RESPECT TO ANY LITIGATION BASED HEREON OR ARISING OUT OF, UNDER OR IN CONNECTION WITH THIS CONTEST.
